Terms
In these below Terms and Conditions ‘STA’ ‘Stream-The-Angels ‘Funeral Streaming’ ‘we’ ‘us’ ‘our’ and ‘ours’ refer to Stream The Angels.com, a T/A brand under Beyond Vision a RSA and UK registered limited liability company. The words ‘Client’ and ‘Customer’ refer to the party who commissioned and/or funded the work and any person or organization acting on their behalf.
These Terms and Conditions apply to all video and associated audio product created by STA
By accessing the website at https://www.streamtheangels.com, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark laws of South Africa and United Kingdom or any other country that the live stream originates from.
2.Users
Visitors to the Platform are “Users”, whether or not they have registered on the Platform. There are three main categories of Users, some with unique sets of rights and responsibilities. The categories are:
“Account Holders” are individuals with registered accounts on the Platform. Account Holders might be the administrators of one or more memorials or living memorials, or they may have a User account without administrative privileges. Account Holders have profile pages which they control the content of.
“Keepers” are Account Holders who create, manage, and administer one or more memorial pages. Keepers have the right to create memorial pages, manage the content on said page, allow other Account Holders to act as Keepers on the memorial pages they manage, and to control the privacy settings of the memorial pages. Keepers should, where possible, be the spouse, child, parent, sibling, grandchild, or grandparent of the subject of the memorial page, or have authorization from one of the above. In the event of a dispute or conflict among, or complaint from Users regarding who is entitled to act as Keeper of a memorial page or any content on said page, we will endeavour to respect the desires of the memorial subject’s immediate family. We reserve for ourselves the sole right to determine whether or how to resolve such dispute, conflict or complaint, with or without factual or other investigation, including the right to remove the page entirely.
- Disclaimer
The materials on the www.Streamtheangels.com website are provided on an ‘as is’ basis. STA makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Further, Stream The Angels does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
- Limitations
In no event STA or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Stream The Angels website, even if a STA authorized representative has been notified orally or in writing of the possibility of such damage. Because some country jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
- Accuracy of Materials
The materials appearing on the STA website could include technical, typographical, or photographic errors. The STA does not warrant that any of the materials on its website are accurate, complete or current. Stream The Angels may make changes to the materials contained on its website at any time without notice this does not include automatic updates to the materials.
- Links
Vendor sites linked to it the STA website does not imply endorsement by STA or its holding company and are there to offer secondary services only that have been vetted by STA. Use of any such linked website is at the user’s own risk.
- Modifications
Stream The Angels may revise these terms and conditions of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service as well as the platform as it is developed at that time.
- Booking
Payment in full is required at least 48 hours before the event. An invoice will be sent prior to the scheduled along with the link to the memorial page. It is understood that payment within a 48-hour window may not be possible with late bookings, this can be worked out on a case-by-case basis.
- Cancellation & Termination
We can withdraw, cancel or amend a booking if it has not been accepted by you, or if the project has not started, within a period of 10 days from the date of the booking, (unless the booking has been withdrawn).
Either we or you can cancel the order for any reason prior to your acceptance (or rejection) of the quotation.
If you want to amend any details of the booking or project you must tell us in writing as soon as possible. We will use reasonable endeavors to make any required changes and additional costs will be included in the Fees and invoiced to you if major changes are required.
If due to circumstance beyond our control, including those set out in the clause below, we have to make any change in the website or how they are provided, we will notify you immediately. We will use reasonable endeavors to keep any changes to a minimum.
Cancellations less than 48h prior to day of the live-stream will not be refunded. Cancellations made after having your booking confirmed, but prior to the 48 hour window will incur an admin fee for any services already provided.
In some circumstances, due to lockdown laws, the agreed will not be able to go ahead as agreed or at all, and is therefore ‘frustrated’. In this scenario a full refund will be issued.
- Refunds
In the unlikely event, we fail to produce the live video stream due to circumstances that are under our control, Stream The Angels will offer a full or part refund.
However, we cannot be held responsible for the failure of the platforms we use to host the live video stream, adverse weather conditions and/or poor signal. On rare occasions where there is joint responsibility an amount of the fee will be refunded, and the decision to provide them, are at STA’s sole and absolute discretion, and the provision of a refund in one instance does not entitle anyone to a refund in the future under similar or different circumstances.
In the event of a failed stream due to poor connectivity, a copy recorded onto the camera will be uploaded at the first available opportunity.
- These terms and conditions are governed by and construed in accordance with the laws of the Republic of South Africa and United KinGoverning Lawgdom and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
- Sharing Your Content and Information
You confirm that you own or have authorization from the owner for all of the content and information you post on the Platform. Keepers can control how the information is used or disseminated on a memorial page. In addition:
Portions of the Services may allow you and other Users to contribute material to be displayed on the Services (“User Provided Content”). For User Provided Content, we are merely hosting and providing access. We cannot accept any liability with regard to such material (including with respect to its accuracy).
The decision to upload information to the Services is your responsibility and you should only submit content that belongs to you or that you have authorization to use and that will not violate the rights of others. Be aware that you should not reproduce or submit anything without permission of the owner. By submitting material to the Services, you represent that you have the right to do so or that you have obtained any necessary third party consents (e.g., under privacy or intellectual property laws). Upon our request you agree to furnish us with any documentation, proof and releases necessary and reasonably required to verify and substantiate your compliance with this provision.
For content that is covered by intellectual property rights, like photos and videos (IP content), you specifically give us the following permission: you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that you post on or in connection with the Platform or Services (IP License).
When you delete IP content, you understand that removed content may persist in backup copies for a reasonable period of time. You further understand and are aware that even after IP content has been removed from the Platform, copies of content posted publicly may be preserved in cashed or archived paged and may have been captured and stored by other Users pursuant to the User Licence paragraph above.
- Safety
We do not guarantee safety on the Platform. To help maintain the safety of the Platform, you commit to the following:
You will not post unauthorized commercial communications (such as spam) on the Platform.
You will not collect Users content or information, or otherwise access the Platform using automated means (such as harvesting bots, robots, spiders, or scrapers) without our prior permission.
You will not upload viruses or other malicious code.
You will not solicit login information or access an account belonging to someone else.
You will not post content that is: hate speech, defamatory, threatening, or pornographic; incites violence; or contains nudity or violence.
You will not facilitate or encourage any violations of these Terms or our policies.
Protecting Other People’s Rights
We respect other people’s rights, and expect you to do the same.
You will not post content or take any action on the Platform that infringes or violates someone else’s rights or otherwise violates the law.
You will not use the Platform to do anything misleading, malicious, or discriminatory.
We can remove any content or information you post on the Platform if we believe that it violates these Terms or our policies.
If we remove your content for infringing someone else’s copyright, and you believe we removed it by mistake, we will provide you with an opportunity to appeal.
If you repeatedly infringe other people’s intellectual property rights, we will disable your account when appropriate.
You will not use our copyrights or trademarks (including Stream The Angels.com.), or any confusingly similar marks without our prior written permission.
You will not post anyone’s identification documents or sensitive information on the Platform.
